I also have the same status. I think it has to do with finger printing when had filed for 485 during July 2007. My status is like that since Dec 2007 .Nothing has changed after that for me..

HI All,
My H1 will expire by the end of October and my employer has applied for LCA on First week of Sept and it got denied. (the status on iCert shows as Denied). My employer has sent the FEIN Info and waiting for info from DOL.
I am not sure how long we will wait for DOL to respond back on this .. Do we need to reapply for LCS as i need to apply for H1-extn before end of October..
Could Pls some one suggest the best course of action..

Hang in there it takes 5 working days to get the LCA approved once you send the FEIN details.

Hi.
I am planning to invoke AC21 via H1B.
My old employer have no issues continuing the same attorney for my future needs.
My new employer asked me to go with their attorney... but I am planning to go with my old guy who applied my 485.
Can I pay AC21, future expenses etc charges from my pocket since I am going with my old attorney.
Is it OK to me paying fees for the GC instead of Employer? Or I shud go with New company Attorney?
Appreciate your help on this.

I would suggest that take an info pass and meet an immigration officer and explain the situation to him personally and if possible given him a written explanation too. What i find a little wired that when you applied for extension you did not notice that that I 94s got exhanchged and even if you did you went ahead and applied for extansion. In my opinion never apply for extension as the applicants next visit is in jeopordy irrespective of result of extnsion of i 94 .

I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?

So the letter is just an employment continuation or verification letter and has nothing that states the spousal details or spouse's intention to accompany the H1 holder. I hope I got that right.

Hi,
My 6th year H1 expires in Feb'07 and company is ready to apply 7th year extension using premium processing. Assuming I get H1 extended by Oct 1st and travel to India in Nov for 2 weeks, is there a problem in coming back with old visa.
Since the appointments are full for the next 6 months I don't have any realistic chance of getting new stamping done during the trip. I know traveling while extension is pending is a big NO NO but if extension is approved am I allowed to use the old visa stamp?

We had the same situation with my wife's H1-B. We spoke to the lawyer and he had forwarded us an e-mail reply from USCIS, stating that USCIS had decided to issue the validity of 797 from the date of adjudication or approved date rather than from the previous expired h1B date and this is not happening across all the cases. I also have applied at the same time as my wife's h1 and My h1b dates are matching.

I efiled on April 7th and got FP notice on April 15th or so with appointment date of April 30th. Hope this helps.

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.
